## What is Section 75 Protection

Section 75 consumer protection creates joint liability between credit card issuers and merchants for purchase-related issues. When you use eligible credit to finance transactions, both the supplier and credit provider become responsible for resolving problems like breach of contract or misrepresentation.

## Eligibility Requirements

The key difference between Curve card types:

**Curve Debit cards ❌** - Transactions using Curve debit cards are not covered under Section 75 consumer rights, as third-party purchases through Curve don't constitute direct credit card purchases. However, you may qualify for Curve Customer Protection, enabling chargebacks for damaged goods, incorrect descriptions, or ceased trading merchants.

**Curve Credit cards ✅** - Eligible purchases made with Curve Credit cards receive full Section 75 protection under consumer credit legislation.

Section 75 claims must meet specific criteria for consumer credit protection. Here are the requirements for Curve Credit card transactions:

## How the Protection Works

### Legal Framework

When you make qualifying purchases using your Curve Credit card for all or part of the transaction value, you are protected against contract breaches and misrepresentation. This applies to situations involving faulty goods, non-delivery, or services not matching their description.

### Joint Liability

Curve Credit Limited, as the issuer of credit under your Curve credit Card Agreement, becomes jointly and severally liable alongside the supplier under Section 75 consumer protection. This dual liability means you can pursue claims against either party for:

*   Breach of contract by the supplier
*   Misrepresentation of products or services
*   Issues occurring before or during the purchase process

If the supplier cannot or will not resolve your issue, you can escalate the matter directly to Curve for investigation and potential reimbursement.

## Making a Section 75 Claim

You can file consumer protection claims against either the supplier or Curve for purchases made within the past six years. When filing with Curve, we'll investigate your claim and provide full reimbursement if valid.

### Required Documentation

To process your Section 75 claim efficiently, please provide:

### Alternative Protection Options
